SIMPLE JANE POLICY CONCERNING UNSOLICITED SUBMISSIONS
Simple Jane Films (“Simple Jane”) does not accept or review unsolicited creative materials of any kind, including, without limitation, ideas, concepts, pitches, suggestions, stories, scripts, screenplays, treatments, formats, artwork, photographs, drawings, videos, reels, audiovisual works, musical compositions, lyrics, sound recordings, program formats, characters, titles, and other creative works or materials (collectively, “Unsolicited Material”).
The purpose of this policy is to avoid potential misunderstandings or disputes when projects developed, acquired, produced, or otherwise considered by Simple Jane may be similar to ideas, concepts, themes, characters, stories, formats, or other materials submitted by third parties.
Please do not send Simple Jane any creative material unless Simple Jane has specifically requested the material and you have completed and signed any Submission Release or other documentation required by Simple Jane before submission.
Simple Jane has no obligation to review, consider, respond to, retain, preserve, return, or otherwise acknowledge any Unsolicited Material. Any Unsolicited Material received by Simple Jane may be deleted, destroyed, discarded, or otherwise disposed of at any time and without notice.
Simple Jane and its representatives regularly develop, acquire, receive, and consider numerous projects, ideas, concepts, stories, characters, themes, formats, and other creative materials. Such materials may be similar or identical in whole or in part to materials independently created or submitted by others.
If, despite this policy, you nevertheless transmit or send Unsolicited Material to Simple Jane by any means, you acknowledge and agree that:
No Confidential Relationship. Simple Jane has no obligation to treat the Unsolicited Material as confidential, proprietary, or secret, and no confidential, fiduciary, or other special relationship is created by your submission.
No Obligation to Review or Respond. Receipt of Unsolicited Material does not constitute acceptance of the material for review, consideration, development, acquisition, production, or any other purpose. Simple Jane has no obligation to review, evaluate, retain, return, preserve, acknowledge, or respond to the Unsolicited Material.
No Agreement to Compensate. Your submission does not create any express or implied agreement, understanding, promise, or obligation requiring Simple Jane to compensate, credit, notify, contract with, or otherwise provide anything of value to you.
Independent Development and Similar Materials. Simple Jane may already have developed, acquired, received, considered, or be developing or considering materials that are similar or identical to your Unsolicited Material in theme, concept, premise, plot, character, format, title, setting, subject matter, or other elements.
Similarity Does Not Establish Use. You acknowledge that the existence of similarities between your Unsolicited Material and any project, production, work, or material developed, acquired, produced, distributed, or otherwise exploited by Simple Jane does not, by itself, establish that Simple Jane copied, used, or derived such material from your submission.
No Restriction on Simple Jane. Receipt of Unsolicited Material will not restrict or impair Simple Jane’s right to independently develop, acquire, finance, produce, distribute, license, exploit, or otherwise pursue any project or material, including projects or materials that may contain elements similar or identical to those contained in the Unsolicited Material.
No Waiver of Rights. Nothing in this policy grants Simple Jane ownership of your Unsolicited Material solely by virtue of its receipt, nor does receipt of the material expand any rights you may have under applicable law. This policy is intended to confirm that Simple Jane has not solicited or agreed to accept the material and has assumed no contractual or other obligation to you as a result of receiving it.
Any creative material specifically requested by Simple Jane will be considered only in accordance with the terms of a separate written Submission Release or other written agreement required by Simple Jane.
By transmitting Unsolicited Material to Simple Jane despite this policy, you acknowledge that you have read and understand the foregoing.
